Defamation

GOVERNING LAWS
– Federal Decree-Law No. 34 of 2021 Concerning the Fight Against Rumours and Cybercrime (the Cybercrimes Law);

– Federal Decree-Law No. 31/2021 On the Issuance of the Crimes and Penalties Law (the Penal Code).

What is Defamation in UAE Law?

Articles 425 and 426 of the new Criminal Code provide for two main crimes of defamation: Article 425 prohibits the public allegation of a fact against someone that exposes the victim to punishment or humiliation, and Article 426 refers to publicly insulting someone in a way that may offend the victim’s honor or dignity. Dubai’s highest court, the Court of Cassation, has ruled that a defamatory statement is likely to subject the person defamed to “punishment” or “humiliation”.

If found guilty of an offence under the Penal Code, individuals can face a fine of up to AED 20,000 or a prison sentence of up to two years for an offence under Article 425 or one year under Article 426. If a statement is made against a public official, it will be considered an aggravating circumstance, which may result in an increased penalty. However, the new Penal Code also introduces new defenses if the incident attributed to a public official is proven to be factual and related to his duties. Statements which insult a person’s honor or the reputation of their family will also be subject to penalties at the more severe end of the scale.

The new Penal Code also introduced a separate crime, carrying its own penalty, to interfere with the right to privacy and family life by recording or transmitting private conversations or taking or transmitting pictures of a person in private, in each case without consent. This offence is mirrored in the new Cybercrimes Law, which also makes it an offence to spread news, images, footage and information, even if true and correct, if done with the intent to harm a person. Conviction can carry a hefty fine of AED 250,000 – AED 500,000 and/or a prison sentence of at least one year upon conviction. The complainant can file a civil claim for damages in tort. “wrongful acts causing harm” and may be entitled to compensation, provided the elements of the case can be proved. Theft is the criminal offence of dishonestly taking someone else’s property both without their consent and with the intention of permanently depriving them of it.
Theft comes in many different forms such as: shoplifting, burglary, etc. Typically the greater the value of what is stolen; the more seriously the crime of theft is regarded. Furthermore, it is also considered more serious if the theft has been planned in advance.
Robbery is the criminal offence of forcibly threatening to steal or actually forcibly stealing from a person. It is often described as a form of aggravated theft in the sense that the offence of theft is established. However, additional elements that elevate it from being just a theft are the presence of a victim and the use of force, a threat, or intimidation towards the victim (either before or during the theft).
theft is punishable by jail sentence of at least six months or a fine. Having said that, Article 442 of the UAE Penal Code states that a theft committed in a means of transport is punishable with imprisonment of not less than one year. Article 441 also provides for imprisonment of up to seven years if theft is committed during night time and by a person carrying a weapon.
If a person has committed robbery by coercion or threat to use a weapon with the purpose of either keeping, obtaining or running away with the stolen goods, he shall be punished with imprisonment ranging between three years to fifteen years under Article 438 of the UAE Penal Code.

Sex Crimes

Previously, under Federal Law No. 3 of 1987, living with an unmarried partner was punishable by a year in prison. Amendments to the Federal Decree-Law No. 15 of 2020 announced last year decriminalized consensual relationships between unmarried couples. The most recent Penal Code regulates extramarital relations by providing a mechanism for the spouse or guardian to file a lawsuit.

Significant Amendments to New Penal Code

The Federal Decree-Law No. 31 of 2021 concerning the UAE Penal Code, released in November 2021 as part of the UAE’s most significant set of legislative changes, intends to boost women’s and domestic workers’ protections while promoting social cohesion public safety.
The new law effectively decriminalizes consensual relationships out of marriage and provides that any child conceived as a result of the relationship is acknowledged and will be cared for.
However, any couple conceiving a child outside of marriage will be required to marry or singly or jointly acknowledge the child and provide identification papers and travel documents in accordance with the laws of the country of which either is a citizen. Failure to comply could lead to prison terms.
The new law stipulates life imprisonment for rapists. If the victim is under the age of 18, disabled or otherwise rendered in a condition unable to offer resistance, the sentence can be extended to capital punishment.
This law also covers indecent assault of both sexes, which will be punished with imprisonment or a fine of no less than Dh10,000, regardless of the victim’s sex. If the use of force or threat is employed in the course of the crime, the penalty will be a jail term of between five and 20 years.
